Copyright notice and Terms of Use

I set up this web site in the hope that you will enjoy my work and perhaps find it inspirational. As a contribution to the community, I do not require registration, I provide images at a fairly high resolution, and allow personal "fair use", which includes use as screen-saver or background image, emailing a copy to a friend, printing a copy on your printer (for example for a school report), or use on a personal or non-profit web page. Please read carefully the terms of use below.

However, you must understand that it is not possible for a photographer to sustain his activities if his images fall into the public domain. Copyright is the essence of my ability, as a photographer, to earn income by leasing images, and I ask you to respect it. Unless explicitly mentioned otherwise, all photographs and text appearing on the Terra Galleria site are the exclusive intellectual property of Quang-Tuan Luong and are protected under United States and international copyright laws. No images are within the Public Domain, and no image use besides those authorized in this document are permitted. In the event that an infringement is discovered you will be notified and invoiced the industry-standard triple fee for unauthorized usage and/or prosecuted for Copyright Infringement in US Federal Court. All images are registered with the US Copyright office.

  1. All use of "Quang-Tuan Luong" images must carry appropriate copyright information acknowledging that the copyrights to all images are owned by "Quang-Tuan Luong". Further no license is granted in respect of any property rights.
  2. The images of "Quang-Tuan Luong" which you obtain from any source are licensed to you by Quang-Tuan Luong for the limited purpose of personal use. This does not mean that title to the image was transferred to you. You own the medium on which the images are recorded, but Quang-Tuan Luong retains full and complete title to the images, and any intellectual property rights therein. You may not redistribute or reproduce multiple copies, make derivative works, perform or otherwise use in a public way the images except as part of your own personal website. Images may not be sold or used in any way, including but not limited to, the selling of products, or in connection with the promotion of any type of affiliation program wherein commissions are earned for producing links to a commercial enterprise. This includes use on a commercial web site.
  3. All images must accurately represent the original work and be used in their entirety without tampering, additions, cropping, low quality reproduction, or other manipulation that would affect the integrity of the image.
  4. All sites displaying "Quang-Tuan Luong" images must provide a link to the Terra Galleria website (www.terragalleria.com). An example of appropriate code is:

Permission is granted to anyone, without any restriction, to make a link to any of the Web pages (html files) included in this server, however a direct link to any image is considered to be an "image use", and therefore must comply with the conditions listed above.

I reserve the right to make future changes to these guidelines. By using any "Quang-Tuan Luong" image you thereby consent to these guidelines and any future changes.
