Either you or Computer Games Online may terminate this Agreement at any time. Without limiting the foregoing, we may terminate this Agreement or withdraw service immediately if you breach this Agreement, if you infringe third party intellectual property rights, or if we are unable to verify or authenticate any information you provide to us. Following termination or withdrawal of service, we may remove some or all of your content on our servers or elect to retain it, at our option.
ALL SERVICES AND PRODUCTS ARE PROVIDED "AS IS." WE AND OUR SUPPLIERS DISCLAIM ALL WARRANTIES AND CONDITIONS, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT GUARANTEE CONTINUOUS OR UNINTERRUPTED ACCESS TO THIS SITE. SOME STATES DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE FOREGOING DISCLAIMER MAY NOT APPLY TO YOU. OUR LIABILITY, AND THE LIABILITY OF OUR SUPPLIERS, TO YOU OR ANY THIRD PARTY IS LIMITED TO THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SITE. SOME STATES DO NOT ALLOW THE LIMITATION OF LIABILITY, SO THE FOREGOING LIMITATIONS MAY NOT APPLY TO YOU.
The following applies to any content you submit to Computer Games Online: You are solely responsible for your content, and we act as a passive conduit for your online distribution and publication of your information. However, we may take any action with respect to your content if we believe it may create liability for us or may cause us to lose (in whole or in part) the services of our ISPs or other suppliers.

In addition, you may not distribute spam that directs or encourages users to visit the Site through the account of another provider. At our option and without further notice, we may use anti-spam technologies, such as automatic word and spam filters, that may terminate your messages without delivering them or prevent messages from reaching you.
Computer Games Online does not claim ownership of the content you place on the Site. By submitting content to Computer Games Online for inclusion on the Site, you grant Computer Games Online the world-wide, royalty-free, and non-exclusive license to reproduce, modify, adapt and publish such content by all means and in any media now known or not currently known, solely for the purpose of displaying, distributing and promoting such content.
This Agreement shall be governed in all respects by the laws of the State of New York as such laws are applied to agreements entered into and to be performed entirely within New York between New York residents. Both parties submit to personal jurisdiction in New York and further agree that any cause of action arising under this Agreement shall be brought in a court in New York, New York. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. If we ask a third party to provide services through the Site, the provisions of this Agreement shall apply to your use of their services. We shall not be liable for any delay or failure to perform resulting directly or indirectly from any causes beyond our reasonable control. We may freely assign this Agreement. This Agreement sets forth the entire understanding and agreement between us with respect to the subject matter hereof.
