The FIA International Court of Appeal met in Paris on Monday, December 4, 2006, to examine an appeal lodged by the Automobile Club d’Italia/Commissione Sportiva Automobilistica Italiana (ACI/CSAI) on behalf of its competitor Vortex srl against decision N°9 of the Panel of the Stewards of the Meeting taken on 17 November 2006. Event run at Angerville (F) from 28 September to 1 October 2006 and counting in the 2006 CIK-FIA World Karting Championship.
By virtue of Article 179 bis of the International Sporting Code, and on the basis of video evidence provided after the event concerned which establishes a violation of the Regulations applicable to the procedure concerning the starting grid for the CIK-FIA Championships, the Stewards decided on 17 November 2006 to exclude the driver Francesco Antonucci, competitor Vortex srl, from the 2006 CIK-FIA World Karting Championship. Vortex srl therefore appealed to the International Court of Appeal.
Having heard the explanations of both parties and having examined the various documents and other evidence, the Court rejected the appeal formulated by the competitor Vortex srl and confirmed decision N°9 taken by the Panel of the Stewards of the Meeting on 17 November 2006, on the grounds that unauthorised work was carried out on kart N°15 (other than changing wheels or verification of tyre pressure, the only work authorised by the Regulations at that stage of the event) and for breach of the CIK-FIA Regulations which allow only one mechanic to work on the kart.
The International Court of Appeal was presided over by Mr Philippe ROBERTI de WINGHE (Belgium), elected President, and composed of Mr Edwin GLASGOW (Great Britain), Mr Erich SEDELMAYER (Austria) and Mr Jan STOVICEK (Czech Republic).
