TERMS AND CONDITIONS FOR DOWNLOAD, INSTALLATION AND USE OF THE SCREENSAVER ("Terms and Conditions")

By clicking on the 'accept' button, installing or otherwise using the screensaver, you are agreeing to be bound by these terms and conditions. Don't download the screensaver if you don't want to be so bound.

Licence : The Economist Newspaper Limited (The Economist) grants you a personal, non-exclusive, non-transferable licence to use one copy of the Software. The term Software includes all aspects of the screensaver, including without limitation its technical capabilities, code, text, graphics, logos, trademarks, content or material. You may only use one copy of the Software. However, you may make one back-up copy, which will also be subject to these terms and conditions. You may only use the Software for your personal, non-commercial use. You may not copy, modify, alter or make any changes to the Software or any part of it. You may not loan, rent, lease or license (whether for a fee or otherwise) the Software, or make it (or any copy of it) available to others. If you have any queries please use the contact form.

Copyright and other intellectual property rights: All intellectual property rights in the Software are owned by The Economist (or its licensors) and are protected by law. The Economist and Economist.com brands are registered trade marks.

Exclusion of Warranties and Limitation of Liability: The Software is provided "as is" and your use the Software is at your own risk. The Software may contain significant or insignificant program errors, bugs and viruses, which may cause an operational interruption to your computer system. You must screen the Software for viruses before downloading it to your computer. Except to the extent that such terms cannot be limited or excluded by law, no conditions, warranties, representations or other terms, whether express or implied shall apply with respect to the Software.

 

Except to the extent permitted by law, The Economist disclaims all liability (howsoever arising) in connection with any loss, damage and/or expense arising out of or in connection with downloading, installation or use of, or inability to use the Software. In particular and without limitation to the generality of the above, The Economist shall not be liable for any: loss of use of or damage to a computer equipment, software or data; financial loss; or indirect, special or consequential loss or damage.

Termination: Your licence to use any copy of the Software may be terminated by The Economist at any time with one day's notice. Your licence automatically terminates if you do not comply with any provisions of these terms and conditions. Upon termination of the licence you must destroy all copies of the Software in your possession. The Economist may discontinue the provision of the Software at any time.

Entire agreement, applicable law and jurisdiction: These terms and conditions apply in addition to the terms and conditions applicable to use of the Economist.com website (www.economist.com). They are the complete and exclusive statement of the agreement between you and The Economist with respect to the Software. These terms and conditions are governed by English law and both parties submit to the non-exclusive jurisdiction of the English Court .
