Terms of Use
General Information

The Terms cover the entire agreement between each user and FILIPINIANA.NET and govern each users use of the FILIPINIANA.NET sites, superseding any prior agreements. Each user may be subject to additional terms and conditions that may apply when that user uses affiliate services, third party content or third party software.

Please report any violations of the Terms to FILIPINIANA.NET Administrator.

Acceptance of Terms

FILIPINIANA.NET provides information and services to the user conditioned upon the users acceptance without modification of the terms and conditions of use herein contained. The use of FILIPINIANA.NET sites, by, itself, constitutes agreement to such Terms.

FILIPINIANA.NET reserves the right to modify these Terms. Such changes will be effective immediately upon posting to the site. The users continued use of FILIPINIANA.NET sites following the Terms changes will be understood to mean acceptance of said changes.

The user agrees not use FILIPINIANA.NET sites or any of the content obtained therein for any purpose that is unlawful or prohibited by these Terms. Violation of these terms results in automatic termination of the users privilege to use FILIPINIANA.NET sites.

The user agrees not to sell, resell or offer for any commercial purposes, any portion of, use of or access to FILIPINIANA.NET sites.

Registrationv

Upon request, each FILIPINIANA.NET user must:

  • Provide true, accurate, current and complete information required in filling up on the FILIPINIANA.NET registration form (collectively, the Registration Data).
  • Maintain and promptly update the Registration Data as necessary to keep it true, accurate, current and complete.

If FILIPINIANA.NET has reasonably grounds to suspect that any user is not in compliance with the above, FILIPINIANA.NET may suspend or terminate that users account and prohibit any and all current or future use of the FILIPINIANA.NET sites (or any portion thereof) by that user.

Each user will receive a password and account designations upon completing the FILIPINIANA.NET registration process and is wholly responsible for maintaining the confidentiality thereof and wholly liable for all activities occurring thereunder. FILIPINIANA.NET will not be liable for any loss or damage arising from a users failure to comply, including any loss or damage arising from any users failure to:

  • Immediately notify FILIPINIANA.NET of any unauthorized use of his or her password or account or any other breach of security.
  • Ensure that he or she exits from his or her account at the end of each session.

FILIPINIANA.NET handles user Registration Data in accordance with its Privacy Policy.

Content

FILIPINIANA.NET sites are owned and operated by FILIPINIANA.NET for the purpose of expanding the appreciation and depth of knowledge of Philippine history and culture through research, discussion, and expression (the Purpose).

FILIPINIANA.NET reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, some or all of FILIPINIANA.NET sites.

FILIPINIANA.NET shall not be liable to any user or other third party for any such modification, suspension or discontinuance.

FILIPINIANA.NET shall not be responsible for information, data, text, music, sound, photographs, graphics, video, messages or any material publicly posted or privately transmitted, via FILIPINIANA.NET sites. Such materials shall be the sole responsibility of the person from whom such Content originated.

FILIPINIANA.NET does not guarantee the accuracy, integrity or quality of such Content and under no circumstances will be liable in any way for such Content, including but not limited to, liability for any error or omission or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise transmitted via FILIPINIANA.NET sites.

The user may be exposed to Content that is offensive, indecent or objectionable. It is the users responsibility to evaluate and bear all risks associated with the use of any Content, including reliance on the accuracy, completeness, or usefulness of such Content.

FILIPINIANA.NET shall not allow any user to transmit Content or conduct or participate in activities in FILIPINIANA.NET sites that, in the judgment of FILIPINIANA.NET, are likely to be prohibited by law in any applicable jurisdiction, including, but not limited to laws governing the transmission of obscenity or the permissible uses of intellectual property.

FILIPINIANA.NET reserves the right to refuse or delete any Content it reasonably deems not to fulfill its Purpose or to violate any of the Terms or to be illegal. FILIPINIANA.NET may preserve Content and may also disclose Content if required by law or by judicial or governmental mandate or as reasonably determined useful by FILIPINIANA.NET to protect the rights, property, or personal safety of FILIPINIANA.NET users and the public.

Licensing Other Terms Applying to Content Posted in FILIPINIANA.NET

Nothing herein shall be deemed to create an agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship of any kind between FILIPINIANA.NET and any user or other person or entity nor do these terms of service extend rights to any third party

Use, reproduction, modification and other intellectual property rights to data stored in FILIPINIANA.NET sites will be subject to licensing arrangements that may be approved by FILIPINIANA.NET as applicable to such Content.

The submitting user retains text or data entered into and stored in publicly-accessible site features such as articles, news and comments. The unauthorized reproduction or distribution of such content is strictly prohibited. With respect to publicly-available statistical content which is generated by the site to monitor and display content activity, such content is owned by FILIPINIANA.NET. In either case, the submitting user grants FILIPINIANA.NET the royalty-free, perpetual, irrevocable, non-exclusive, transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such Content (in whole or part) worldwide and/or to incorporate it in other works in any form, media or technology now known or later developed, all subject to the terms of any applicable license.

With respect to Content posted in private areas of FILIPINIANA.NET (e.g., private development tools or mail), the submitting user may grant to FILIPINIANA.NET or other users such rights and licenses as the submitting user deems appropriate.

While FILIPINIANA.NET will use reasonable effort to back up site data and make such data available in the event of loss or deletion, FILIPINIANA.NET has no responsibility or liability for the deletion or failure to store of any messages and other communications or other Content maintained or transmitted by any FILIPINIANA.NET site.

Account Status

FILIPINIANA.NET may terminate a users account for any reason. FILIPINIANA.NET is especially likely to terminate for reasons that include, but are not limited to, the following:

  • violation of these Terms
  • abuse of site resources or attempt to gain unauthorized entry to the site or site resources
  • use of FILIPINIANA.NET in a manner inconsistent with the Purpose
  • users request for termination
  • as required by law, regulation, court or governing agency order

FILIPINIANA.NET termination of any users access to any or all FILIPINIANA.NET sites may be effected without notice and, on such termination, FILIPINIANA.NET may immediately deactivate or delete the users account and/or ban any further access to such files.

FILIPINIANA.NET shall not be liable to any user or other third party for any termination of that users access or account hereunder. In addition, a users request for termination will result in deactivation but not necessarily deletion of the account. FILIPINIANA.NET reserves the right to delete, or not delete, a users account as well contents of that site.

FILIPINIANA.NET reserves the right to mark as inactive and archive accounts and/or Content that are inactive for an extended period of time.

Links

FILIPINIANA.NET or a third party may provide links to other websites however, FILIPINIANA.NET exercises no control over such other websites and web-based resources and is not responsible or liable for the availability thereof or the content, advertising, products or other materials thereon. FILIPINIANA.NET shall not be responsible or liable, directly or indirectly, for any damage or loss incurred or suffered by any user in connection therewith. The users access and use of linked websites, including information, material, products and services therein, is solely at the users risk.

The FILIPINIANA.NET Privacy Statement is applicable only on an FILIPINIANA.NET sites. The user should read the privacy statement on a linked-to website before disclosing any personal information thereon.

RSS Feeds

FILIPINIANA.NET offers an RSS feed as a free service to individuals for private, non-commercial use. All other uses are prohibited, including placing advertising into, around, or targeted towards the FILIPINIANA.NET RSS content. You must use the RSS feeds as provided by FILIPINIANA.NET, and you may not edit or modify the text, content or links supplied by FILIPINIANA.NET.

FILIPINIANA.NET reserves the right to discontinue providing RSS feeds at any time and to require you to cease displaying, distributing or otherwise using the FILIPINIANA.NET RSS feed for any reason. FILIPINIANA.NET expressly disclaims all liability for any of your activities in connection with the RSS feeds or for your use of the RSS feeds in connection with your website.

Indemnity

A user shall indemnify, defend and hold harmless FILIPINIANA.NET and its officers and agents from any and all claims, demands, damages, costs, and liabilities including attorneys fees, made by any third party due to or arising from another users acts or missions, including claims arising out of that users use of FILIPINIANA.NET, submissions, postings or transmissions of content or his or her violation of the Terms.
