Use of logos, reproduction of materials, copyright & disclaimer

Use of logos

The use of any of the Information Commissioner’s logos on any document or in association with any information signifies that the document or information has been prepared or approved by the Information Commissioner.  The logos are used only on materials generated by the Commissioner’s Office or where the Commissioner’s Office has worked in association with an organisation preparing advice on data protection or freedom of information.

Use of any of the Commissioner’s logos without the Commissioner’s consent infringes the copyright held in respect of the logos. No permission will be granted for the use of the logos nor will reproduction of the logos in any form be allowed unless the Commissioner determines that:

• the material on which the logos is to be used; and

• the use of the logos on such material, have been expressly approved by his office.

Use of the Commissioner’s logos (as identified above) should not be confused with use of the Information Padlock signpost symbol. The Commissioner actively promotes the use of the Information Padlock signpost symbol by data controllers and guidance on its appropriate use is available in a leaflet available at http://www.informationcommissioner.gov.uk/eventual.aspx?pg=SR&cID=234

Reproduction of materials

Subject to the conditions set out below, the Information Commissioner has no objection to organisations reproducing in their own publications, or on their internal computer networks, the Introduction to the 1998 Act, notification forms or other materials published by him and issued in electronic form or otherwise. This includes reproduction of such items as the video “Barry’s Bad Data Day”.

The conditions are as follows:

• An acknowledgement of the source of the material so reproduced should be made.

• The material should be clearly separated from any comment made on it by the organisation or others.

• The organisation should ensure that it is using the latest available version of the material.

• Regard should be had to any qualifying statements attached to the published material by the Commissioner, for example concerning its status (e.g. “consultation documents”, “discussion papers”, or “preliminary view”) or the audience to which it is directed.  If the material is reproduced in full, or very substantial extracts are made, any qualifying statements should be included.

• Any reproduction of the Information Commissioner’s application forms, (such as the notification application form) should be clearly marked “SPECIMEN” unless otherwise expressly agreed by the Commissioner.  Readers should be made aware that applications for notification may only be made on the official forms which are only available from the Commissioner’s Office or his website.

• Readers must not be given the impression that the Commissioner is responsible for, or has in any way approved, the publication in which his material is reproduced.

• No fee may be charged by the organisation for the reproduction and/or distribution of the Information Commissioner’s material.

• The organisation shall not alter or amend material published by the Commissioner unless such material is clearly marked as having been altered or amended by the organisation.

Copyright in all materials produced by the Information Commissioner remains with the Information Commissioner.
