Legal Analysis

As part of Buffalo Conversation 3, Kevin Gaughan engaged Hodgson Russ to perform a legal analysis of any impediments to merging the City and the County. The Hodgson Russ Brief and Analysis contains many complex legal issues, but the following points are the key highlights:

  • Merging the City and the County is legally possible.
  • A state Constitution change is not required.
  • Albany will need to enact legislation to permit a local referendum on the issue.
  • A referendum will be scheduled for people to vote on merger, probably on November 1, 2005. The referendum is a "split" referendum where it must receive 50% approval within the old City limits and 50% approval in the balance of the county.
